Weed, CA - Three children ages 13, 11 and 9, currently all maintain valid U.S. citizenship status and reside with their mother Krystal Curle in Weed, California. The children’s names have not been released due to safety concerns.Curle, 38, and husband Jonathan, 37, a Canadian citizen, had been serving as missionaries with Texas based Grace International in Zimbabwe Africa since 1998. In 2009, the couple and children moved back to the United States, to seek marital counseling and safety from political unrest. Jonathan Curle neglected to file the proper paperwork with U.S. Immigration and Customs Enforcement and was ordered to leave the U.S. for a period of 5 years. He returned to Zimbabwe in 2011 leaving Curle and the three children in California.Curle, represented by Marybeth Martinelli and Jonathan represented by William Anderson, argued their case before Siskiyou County Commissioner, JoAnne Bicego in the Siskiyou County Superior Court in Yreka, CA on January 17, 2012. On March 6, 2012, she returned her decision: Though none of the parties considered in this case are citizens of Zimbabwe, she established that it was their habitual residence and jurisdiction of the case be transferred to Zimbabwe, pursuant to The Hague Convention treaty. All three children must be returned to Zimbabwe by April 20, 2012.
With the continuing turmoil in Zimbabwe, and the mother’s inability to accompany the children outside of the airport due to threats made against her, the family is devastated that the Commissioner did not take into consideration issues of safety when determining jurisdiction. “My daughter’s only recourse is to take the children to Zimbabwe and return to the U.S. and attempt to fight this divorce and custody battle in Zimbabwe courts,” stated Keith Chilson, Curle’s father, during a radio interview with KSFO in San Francisco, California. “This could take many months the way the Zimbabwe courts work. My daughter is sending a retainer to a Zimbabwe International Divorce Law Firm to be ready to do this.”
Curle plans to appeal the ruling on the grounds of Article 13b of the Hague Convention treaty, “the requested State is not bound to order the return of the child if [they] establish that there is a grave risk that his or her return would expose the child to physical or psychological harm.” According to the US Embassy, “the safety and security situation in Zimbabwe is unpredictable, and subject to sudden change. The country suffers from a crumbling infrastructure that makes road travel hazardous, communications unreliable, and emergency medical care problematic.” The World Health Organization affirms that Harare, the capital of Zimbabwe and where the children will live upon their return to the country, has been plagued with typhoid and cholera outbreaks and has a high risk of infant and child mortality.
On April 3rd MaeVaughan Chilson’s facebook page read, “This morning there are only 15 days left from what might be the last time we will see our grand babies. I was remembering when our daughter called from Zim in the morning while I was at work saying, ‘We’re going out the back gate, they’re coming in the front’ (the police/guerrillas were forcing their way into the property which was surrounded by high fences & locked gates). She ended the brief call with ‘Don’t call us, we’ll call you’ and hung up. That was a very terrifying day.

Weed, CA - March 31, 2012 – Three children belonging to a Californian mother are being forced to return to Zimbabwe as a result of the Hague Convention International Treaty. The children ages 13, 11 and 9, currently all maintain valid U.S. citizenship status and reside with their mother Krystal Curle in Weed, California. The children’s names have not been released due to safety concerns.
Curle, 38, and husband Jonathan, 37, a Canadian citizen, had been serving as missionaries with Texas based Grace International in Zimbabwe Africa since 1998. In 2009, the couple and children moved back to the United States to seek marital counseling and safety from political unrest. Jonathan Curle refused to follow proper immigration channels with International Customs Enforcement and was ordered to leave the U.S. for a period of 5 years. While a citizen of Canada, he chose to return to Zimbabwe in 2011 leaving Cure and the three children in California.
On January 17, 2012, a Siskiyou County Judge heard the case and on March 6, 2012, returned her decision that under The Hague Convention treaty, jurisdiction of the case be transferred to Zimbabwe. She ordered all three children be returned to Zimbabwe by April 20, 2012. None of the parties considered in this case are citizens of Zimbabwe. Jonathan Curle, who resides in Zimbabwe, has threatened to revoke his children of U.S. citizenship status once in his custody. This would require the children to reapply for legal U.S. citizenship status at age 18.
Over 80 percent of the population in Africa is plagued with HIV due to violent rape. Zimbabwean law allows women and children to be considered property of males. Due to this law, divorce is considered invalid unless it is initiated by the male. According to the CIA world fact book, Zimbabwe is a source, transit, and destination country for men. Women and children are trafficked for the purposes of forced labor and sexual exploitation. Zimbabwean men, women, and children are subjected to forced labor and utilized in the commission of illegal activities.

Curle has been mandated by the U.S. judge to accompany the children back to Zimbabwe to reside with their father. Upon arrival, Curle must immediately board her flight back to the United States. Failure to follow this procedure could result in imprisonment or possibly death.

The Bicycle Tour of Colorado is outdoor enthusiast’s dreams come true. For many years, it was our dream to run a bicycle tour full-time but I had to work full-time and it was not a cheap proposition. I felt passionate about doing it so I had to work very hard to make our dreams come true. There was so much to accomplish but we knew that if we could pull it all together that the outcome would be a great celebration for both cycling and people who love the outdoors. What we never really imagined is how big it would be for our area and show-casing the Colorado Rockies and surrounding area. We had to push on because the tour was going to be something great we could be proud of for years to come. It was not a huge success over night and some might say it has taken 18 years to accomplish this but most people might never imagine all that has to be accomplished to put on this week long adventure. We receive bicyclists from all over the world right here in Colorado and we are responsible for a lot of the logistics and care needed for these riders. We have to get permits for the ride and insurances and so much but after 18 years, we can honestly say that we are just getting started. The Tours best years are ahead of it and we are more excited than ever to host this yearly tour. This is the first year that the Bicycle Tour Colorado is venturing beyond the great state of Colorado and is doing a short ride through Wyoming as well through cities like Laramie and Saratoga. This is a tough ride but the scenery makes it well worth it and so does the accomplishment of it. The ride takes place this year from June 17th through the 23rd and is 18 + years of hard work brought to the cycling teams from around the world. Our tour has all that you will need from first aid to cycle repair to getting your luggage from location to location.
